The Bar Council of India (BCI) on Monday issued an order for the immediate suspension of Supreme Court advocate Rakesh Kishore due to his attack on Chief Justice of India BR Gavai. The BCI announced that disciplinary proceedings will be initiated against Kishore under the relevant legal provisions to address the seriousness of the incident.
As part of the disciplinary process, the BCI will issue a show cause notice to Kishore, requiring him to respond within 15 days of receiving the order. The notice will demand an explanation as to why his suspension should not be continued and why further punitive action should not be taken against him.
The suspension imposes a comprehensive ban on Kishore, prohibiting him from appearing, acting, pleading, or practicing in any court, tribunal, or authority across India.
This restriction takes effect immediately and will remain in place pending the outcome of the disciplinary proceedings.The Bar Council of Delhi has been instructed to enforce the suspension order without delay. This includes updating Kishore’s status on its official rolls to reflect the suspension and notifying all courts and tribunals within its jurisdiction about the decision.
The prompt implementation of these measures underscores the BCI’s commitment to upholding professional standards and addressing misconduct within the legal community.
