CJI assures hybrid court hearings amid Delhi air crisis

Lawyers can opt for virtual hearings says Supreme Court.


Chief Justice of India Sanjiv Khanna on Tuesday addressed concerns raised by senior lawyers regarding the ongoing severe air pollution in Delhi and the request for courts to function entirely online. The CJI emphasised the availability of hybrid hearings, which allow lawyers to appear online while maintaining physical proceedings.

 

The CJI reassured lawyers that judges have been instructed to accommodate virtual hearings wherever possible. He noted that the option to participate virtually remains available, ensuring flexibility for legal professionals amidst the alarming air quality levels.

 

Senior advocate Kapil Sibal, Solicitor General Tushar Mehta, and senior advocate Gopal Sankaranarayanan highlighted the deteriorating air quality, describing it as "out of control."

 

Sibal urged the Supreme Court to implement complete virtual functioning to mitigate risks. In response, the CJI underscored that the hybrid mode is a sufficient alternative, providing convenience while preserving the integrity of court operations.

 

Sankaranarayanan pointed out the significant number of lawyers, clerks, and their vehicles commuting daily to court premises, which contributes to the city's pollution levels. Acknowledging this, the CJI reiterated that the facility for online appearances is in place for those who wish to use it.

 

The discussion comes as Delhi's air quality continues to deteriorate, with the Air Quality Index (AQI) recorded at a hazardous 488, placing it in the ‘severe plus’ category.

 

According to the Central Pollution Control Board (CPCB), the air pollution has caused smog to envelop the city, reducing visibility and posing severe health risks.

 

Vulnerable groups, including children, the elderly, and individuals with respiratory or heart conditions, are especially at risk during this period of extreme pollution.
