Parl scuffle row: Charges filed against LoP Rahul Gandhi

The FIR against Rahul Gandhi was registered under sections 115 (voluntarily causing hurt), 117 (voluntarily causing grievous hurt), 125 (act of endangering life or personal safety of others), 131 (use of criminal force), 351 (criminal intimidation) and 3(5) (common intention) of the BNS.

Scuffle between INDIA bloc MPs and Bharatiya Janata Party leaders on Thursday attracted FIR against the Leader of Opposition Rahul Gandhi after BJP MP Pratap Sarangi sustained head injury during the tussle.

 

Since the event has led to several charges against Rahul Gandhi, one wonders what can be the maximum charges for the Raebareli MP if proven guilty.

 

Delhi Police have slapped Lok Sabha MP Rahul Gandhi with six charges, including a non-bailable one, mentioned in the Bharatiya Nyaya Sanhita (BNS) after the BJP filed a complaint, accusing the Congress MP of physical assault and incitement during a scuffle in Parliament premises.

 

The BJP, in its complaint, accused Gandhi of goondagardi (hooliganism) and using his sharirik Shakti (physical strength) and “kung fu” skills to assault senior parliamentarians of the saffron camp.

 

Swinging into action following BJP’s complaint, the police booked him under the severe BNS section 117, a non-bailable one which offers punishment ranging from seven years to life imprisonment depending on the severity of the injury caused. 

 

The BNS section deals with the offence of causing grievous hurt.

 

However, none of the BJP MPs sustained grievous injury in the scuffle with the Congress. 

    

The FIR against Rahul Gandhi was registered under sections 115 (voluntarily causing hurt), 117 (voluntarily causing grievous hurt), 125 (act of endangering life or personal safety of others), 131 (use of criminal force), 351 (criminal intimidation) and 3(5) (common intention) of the BNS. 

 

Gandhi may be summoned for interrogation in connection with the case, a police officer said.

 

The other five sections against Gandhi are bailable ones.

 

In the BNS, injuries that cause permanent impairment or destruction of the functionality of any body part or joint, such as a limb or finger and the inability to use a body part even without its removal (paralysis) are considered grievous injuries.    

 

Sources in the police said none of the BJP MPs received injuries which can corroborate the definition of the grievous hurt mentioned in the rule-book.
