SC admits changing judge transfer decision after Centre's request

SC collegium reversed its earlier decision, transferring Justice Atul Sreedharan to Allahabad High Court after the Centre's request. This marks a reconsideration of his earlier proposed move to Chhattisgarh.

The Supreme Court collegium recommended the transfer of Madhya Pradesh High Court Judge Atul Sreedharan to the Allahabad High Court, following a request from the Central Government to reconsider an earlier proposal that had suggested his transfer to the Chhattisgarh High Court. 


The decision was made by the collegium, headed by Chief Justice BR Gavai, during a meeting held on October 14.


In its resolution published on the apex court website, the collegium stated, “The Supreme Court Collegium, in its meeting held on October 14, on reconsideration sought by the government, resolved to recommend that Justice Atul Sreedharan, Judge, High Court of Madhya Pradesh, be transferred to the High Court of Judicature at Allahabad instead of the High Court of Chhattisgarh.”


Earlier, in August 2025, the collegium had initially recommended Justice Sreedharan’s transfer to the Chhattisgarh High Court. This proposal came a few months after he had been transferred back to his parent High Court in Madhya Pradesh from the Jammu and Kashmir High Court.


Justice Sreedharan’s transfer history began in April 2023, when he was moved from the Madhya Pradesh High Court to the Jammu and Kashmir High Court at his own request, citing that his daughter had entered legal practice in Madhya Pradesh. He was subsequently transferred back to the Madhya Pradesh High Court in March, following which the collegium proposed his relocation to Chhattisgarh. The government then sought reconsideration of this recommendation, leading to the revised proposal for Allahabad.

Justice Atul Sreedharan began his legal career in 1992 by joining the chamber of Senior Advocate Gopal Subramanium in Delhi, where he assisted in several civil and criminal matters before the Supreme Court, Delhi High Court, and trial courts until 1997. He practised independently in Delhi from 1997 to 2000 before shifting to Indore in 2001, where he continued independent practice and worked closely with Senior Advocate Satyendra Kumar Vyas.


He also served as Panel Advocate and Government Advocate for the State of Madhya Pradesh before the Indore Bench of the High Court. Justice Sreedharan was appointed as an additional judge of the Madhya Pradesh High Court on April 7, 2016, and confirmed as a permanent judge on March 17, 2018.
