MHA seeks President’s nod to prosecute ex-Delhi minister Jain

The Union Home Ministry has sought the President’s approval to prosecute Aam Aadmi Party (AAP) leader and former Delhi minister Satyendar Jain in a money-laundering case being probed by the Enforcement Directorate (ED), sources revealed on Friday.


The ministry has requested sanction under Section 218 of the Bharatiya Nagarik Suraksha Sanhita, citing the presence of “adequate proof” gathered during the ED’s investigation, officials said.


Jain, 60, was arrested by the ED in May 2022 on charges related to money laundering linked to alleged hawala transactions. The case originates from an August 2017 First Information Report (FIR) filed by the Central Bureau of Investigation (CBI), accusing Jain and others of possessing disproportionate assets beyond known sources of income.


Following its investigation, the CBI filed a chargesheet in December 2018, alleging that Jain’s disproportionate assets amounted to Rs 1.47 crore, which was 217% more than his known income between 2015 and 2017.


The ED later took over the probe, citing violations under the Prevention of Money Laundering Act (PMLA). Jain was charge-sheeted and remained in custody until he secured bail in the case.


Apart from financial irregularities, Jain was also accused of running a high-profile extortion racket from Tihar Jail. Allegations surfaced that he demanded Rs 10 crore as ‘protection money’ from jailed conman Sukesh Chandrashekhar, in exchange for ensuring a comfortable stay in prison.


With the Home Ministry formally seeking the President’s sanction, the case against the former minister is expected to gain further momentum. If granted, the sanction would pave the way for legal proceedings against Jain under the Bharatiya Nagarik Suraksha Sanhita.

 

The developments come amid ongoing tensions between the AAP and the central government, with the Delhi-based party alleging political vendetta in cases against its leaders. 


Jain, once a key minister in Arvind Kejriwal’s government, handled crucial portfolios such as health, industries, and power before resigning after his arrest.


The AAP has yet to issue an official statement regarding the Home Ministry’s latest move.
