Akshay Shinde, who was accused of sexually assaulting two girls at a school in Badlapur town of Maharashtra's Thane district was shot by police after he snatched revolver of one of the officers and fired at them.
The Thane crime branch took the custody of accused Shinde in fresh case filed by his wife, from Taloja jail based on the production warrant.
Reportedly, when the vehicle reached near Mumbai bypass — he was being taken to Thane for investigation — Shinde snatched the revolver of one of the officers in the vehicle and fired two to three rounds, injuring the officer.
Reports claim that Shinde, 23, was critically injured during retaliation by the police and later died in hospital.
Shinde was arrested on August 17 for sexually abusing two girls, aged four and five, in a school toilet.
The incident sparked massive outrage amid protests held in the area. Shinde worked as a cleaner at the school.
The local police were initially probing the case, but the Maharashtra government set up a Special Investigation Team (SIT) following a public outcry over serious lapses in the police investigation.
The chairman and secretary of a school in Badlapur have moved the Bombay High Court seeking pre-arrest bail.
A case has been registered against the duo under relevant provisions of the Protection of Children from Sexual Offences (POCSO) Act for not reporting the incident to the police immediately and for negligence.
They approached the high court after a special court denied them anticipatory bail.
Their pleas came up for hearing on Monday before a single bench of Justice RN Laddha, and the court posted the matter for October 1.
In August, the Bombay High Court stepped in on its own to take notice of the case.
