Jharkhand HC raps govt over safety violations in coal mining

The Jharkhand High Court on Monday adopted a tough position on the working conditions, health safeguards, and fundamental rights of coal mine labourers in the state.

 

Acting on its own initiative, a division bench comprising Justice Sujit Narayan Prasad and Justice Sanjay Prasad directed the state’s Chief Inspector of Factories to appear personally at the next hearing to explain the situation.

 

The move comes in the backdrop of strong observations made in recent years by the Supreme Court of India, which has repeatedly underlined that the safety and well-being of mine workers are non-negotiable.

 

The apex court had also cautioned that any form of negligence affecting workers’ lives would invite strict action.

 

Following these directions, high courts across the country were asked to keep a close watch on compliance, prompting the Jharkhand High Court to take up the matter.

During Monday’s proceedings, the state government placed before the bench a report detailing inspections carried out in major coal mines and industrial units, along with an evaluation of adherence to prescribed safety standards.

 

The court, however, found the report unsatisfactory, noting a glaring mismatch between official claims and the actual conditions at mining sites. It questioned the effectiveness of enforcement mechanisms and sought specific information on steps taken to protect workers engaged in high-risk operations.

 

Issuing clear instructions, the bench emphasised that safety regulations must be implemented in letter and spirit, proper healthcare facilities should be made available to workers, and illegal mining activities must be brought to an end.

 

Additionally, the court called for a detailed update on measures related to regularising contractual labour, ensuring payment of minimum wages, and rolling out welfare schemes for those employed in the mining sector.

 

Highlighting the gravity of the issue, the court made it mandatory for the chief inspector of factories to be present at the next hearing and provide a comprehensive account of actions taken so far to comply with judicial directives.
